By purchasing, activating, or using any KIMUQ GPS tracking device, software, or services (“Service”), you agree to the following Terms & Conditions.

1. Service Overview

KIMUQ provides GPS tracking devices and subscription-based services that enable users to monitor location data via mobile and web applications.

The Service includes:

  • Hardware device
  • Cellular connectivity (via third-party networks)
  • Software platform access

2. Subscription & Billing

An active subscription is required for full functionality of the device.

  • Subscriptions are billed on a recurring basis (monthly or annually).
  • Subscriptions automatically renew unless canceled prior to the next billing cycle.
  • Users must cancel at least 24 hours before the billing date to avoid renewal charges.
  • Payments are generally non-refundable, except where required by law or at KIMUQ’s sole discretion.

Failure to maintain an active subscription may result in reduced or complete loss of functionality.

3. Device Warranty & Extended Coverage

KIMUQ devices include a 12-month limited warranty covering manufacturing defects under normal use.

This warranty does not cover:

  • Accidental damage
  • Misuse or unauthorized modifications
  • Water damage beyond rated specifications
  • Normal wear and tear

KIMUQ may, at its sole discretion, provide extended support or replacement options for devices with an active subscription. Such support is not guaranteed and may be modified or discontinued at any time.

4. Connectivity & Network Disclaimer

KIMUQ devices rely on third-party cellular networks and infrastructure.

KIMUQ does not guarantee:

  • Network availability or coverage
  • Data transmission speed or latency
  • Service continuity across all regions or countries

Service performance may be affected by:

  • Geographic location
  • Carrier limitations
  • Government regulations or restrictions
  • Environmental factors

KIMUQ is not responsible for connectivity failures caused by third-party providers.m

5. Device Usage & Legal Compliance

The device is intended for lawful tracking purposes only.

Users agree:

  • To comply with all applicable local, state, national, and international laws
  • Not to use the device for unlawful surveillance or tracking without proper consent

KIMUQ is not responsible for any misuse of the device.

6. GPS Accuracy Disclaimer

Location data is provided for informational purposes only.

KIMUQ does not guarantee:

  • Real-time tracking accuracy
  • Continuous signal availability
  • Precision under all conditions

Accuracy may vary due to:

  • Signal obstruction
  • Network conditions
  • Device placement
  • Environmental interference

7. Data & Privacy

By using the Service, users consent to the collection and processing of location and usage data.

  • Users retain ownership of their data.
  • KIMUQ processes data solely to provide and improve the Service.
  • Data may be stored, transmitted, and processed in accordance with applicable privacy laws.
  • Data retention periods may vary based on operational requirements.

8. Account Responsibility

Users are responsible for:

  • Maintaining account security
  • All activities under their account

KIMUQ may suspend or terminate accounts for:

  • Non-payment
  • Violation of these Terms
  • Suspicious or abusive activity

9. Service Availability

KIMUQ does not guarantee uninterrupted or error-free service.

The Service may be subject to:

  • Scheduled maintenance
  • System upgrades
  • Unexpected outages

KIMUQ reserves the right to modify, suspend, or discontinue any part of the Service at any time.

10. Limitation of Liability

To the maximum extent permitted by law, KIMUQ shall not be liable for:

  • Loss, theft, or damage of property
  • Inaccurate, delayed, or unavailable location data
  • Service interruptions or connectivity failures
  • Indirect, incidental, or consequential damages

KIMUQ’s total liability shall not exceed the amount paid for the device.

11. Indemnification

Users agree to indemnify and hold KIMUQ harmless from any claims, damages, or liabilities arising from:

  • Misuse of the device
  • Violation of laws
  • Breach of these Terms

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Minnesota, United States, without regard to conflict of law principles.

13. Changes to Terms

KIMUQ may update these Terms at any time.

Continued use of the Service after updates constitutes acceptance of the revised Terms.
